There used to be a rule called "illegal setup," which meant that even if you had the power source and antenna connected, but didn't have a license, it was still illegal, even if the device wasn't turned on. I don't know how the current regulations are determined. In my previous work repairing aviation-frequency equipment, all the antennas were connected to fake loads, even handheld radios had antennas connected to fake loads.
