HamCQ Community User Agreement
This English version is provided for reference. In the event of any inconsistency between the Chinese and English versions, the Chinese version shall prevail.
Welcome to HamCQ, a community for amateur radio enthusiasts.
Please read the following terms carefully. If you disagree with any provision of this Agreement, you may choose not to access HamCQ Community.
Once you have successfully registered, your access to HamCQ Community or publication of any content on HamCQ Community ("Content") means that you ("User") fully accept all provisions of this Agreement.
Effective Date and Scope
This Agreement takes effect when you click the "Agree" button or successfully register. It applies to all services provided by HamCQ Community, including but not limited to its website, mobile applications, and APIs.
This Agreement, together with the HamCQ Community Rules, Privacy Policy, Community Amateur Radio Repeater Information Use Rules, Points Rules, Reproduction Notice, and other relevant rules, constitutes the complete service agreement framework. In the event of a conflict, this Agreement shall prevail.
Chapter I Rules of Use
Article 1. After successful registration, HamCQ Community will provide each User with an account and corresponding password. The User is responsible for safeguarding the account and password and bears legal responsibility for all activities and events conducted through the account.
Article 2. Users are fully responsible for the truthfulness, lawfulness, and validity of their registration information. A User must not impersonate another person, publish information in another person's name, or maliciously use an account in a manner that causes other users to misidentify the account holder. Otherwise, HamCQ Community may immediately stop providing services and recover the account, and the User shall bear all resulting legal liability.
Article 3. Any direct or indirect use of HamCQ Community services or data, including through RSS feeds or external API references, is deemed unconditional acceptance of this Agreement. A User who disagrees with any provision must immediately stop using all services provided by HamCQ Community.
Article 4. HamCQ Community is a platform for obtaining, sharing, and distributing information. Information published by Users through HamCQ Community is public and may be accessed by third parties. By publishing information, the User acknowledges that it is public and bears separate legal responsibility for the publication. Information that a User does not want third parties to know should not be published on HamCQ Community.
Article 5. Users undertake not to use HamCQ Community, directly or indirectly, to engage in conduct that violates the laws of China or generally accepted standards of public morality. HamCQ Community may remove Content that violates this undertaking.
Article 6. Users must not use HamCQ Community services to create, upload, copy, publish, disseminate, or reproduce Content that:
- Opposes the fundamental principles established by the Constitution.
- Endangers national security, discloses state secrets, subverts state power, or undermines national unity.
- Damages national honor or interests.
- Incites ethnic hatred or discrimination or undermines ethnic unity.
- Insults or misuses the image of heroes and martyrs, denies their deeds, or glorifies or whitewashes wars of aggression.
- Undermines national religious policies or promotes cults or feudal superstition.
- Spreads rumors, disrupts public order, or undermines social stability.
- Disseminates obscenity, pornography, gambling, violence, homicide, terrorism, or instruction to commit crimes.
- Insults or defames another person or infringes another person's lawful rights and interests.
- Contains other information prohibited by laws or administrative regulations.
Article 7. All Users agree to comply with the HamCQ Community Rules.
Article 8. HamCQ Community may review and supervise the use of its services. If a User violates any provision above, HamCQ Community or an authorized person may require correction or directly take necessary measures, including modifying or deleting Content posted by the User and suspending or terminating the User's right to use HamCQ Community, to mitigate the impact of the misconduct.
Article 9. Account management:
- A User must not lend, transfer, or sell an account to another person.
- Each User may register only one primary account. Malicious registration of multiple accounts is prohibited.
- The platform may recover an account that has remained unused for an extended period.
Article 10. Technical requirements. As an amateur radio community, technical Content published by Users must comply with applicable radio administration laws and regulations. Users must not publish instructions for unlawful operations or dangerous technical information.
Chapter II Intellectual Property
HamCQ Community is a platform for obtaining, sharing, and distributing information. We respect Content created by HamCQ Community Users and encourage Users to recognize that intellectual property protection is important to the survival and development of the Community. HamCQ Community treats intellectual property protection as one of its fundamental operating principles.
Article 1. Copyright in all original Content published by a User on HamCQ Community, including but not limited to answers, articles, and comments, remains with the User. The User may authorize a third party to use that Content in any manner without obtaining HamCQ Community's consent.
Article 2. Logos, layout designs, formatting, text, images, graphics, and other materials contained in HamCQ Community network services are protected by copyright, trademark, and other laws. Without consent from the relevant right holder, including HamCQ Community or another original right holder, such materials must not be directly or indirectly published or used on another platform, adapted or redistributed for publication or use, or used for any other commercial purpose.
Article 3. To promote the sharing and dissemination of knowledge, each User grants HamCQ Community a royalty-free, irrevocable, and non-exclusive license to use all Content that the User publishes on HamCQ Community. HamCQ Community may use that Content in its products and services in any form, including its website, published applications, and other internet products.
Article 4. A third party that reproduces Content published by a User outside HamCQ Community for a non-commercial purpose must prominently identify the original author's name, or the author's HamCQ Community account name, at the beginning of the work, provide a link to the original Content, state "Published on HamCQ Community," and must not modify or adapt the work. To modify the work or use it commercially, the third party must contact the User, obtain separate authorization, and use the Content in the manner specified by the User.
Article 5. HamCQ Community provides Users with an "All Rights Reserved - Reproduction Prohibited" option. Unless separately authorized by the original author, a third party must not reproduce Content carrying this notice. Unauthorized reproduction will be treated as infringement.
Article 6. A User who uploads or publishes Content must ensure that the User owns the copyright or has obtained lawful authorization and that the Content does not infringe the lawful rights and interests of any third party. If a third party raises a copyright objection, HamCQ Community may remove the relevant Content according to the circumstances and may pursue the User's legal liability. The User shall fully compensate HamCQ Community or any third party for resulting losses.
Article 7. If a third party infringes a HamCQ Community User's rights, the User authorizes HamCQ Community or its designated agent to issue warnings, submit complaints, request administrative enforcement, initiate or appeal legal proceedings, or negotiate a settlement on behalf of HamCQ Community or the User. The User agrees to participate in joint rights-protection action where HamCQ Community considers it necessary.
Article 8. HamCQ Community has the right, but not the obligation, to review User Content. It may process allegedly infringing information based on relevant evidence, applicable laws and regulations, and HamCQ Community guidelines.
Chapter III Personal Privacy
Respecting the confidentiality of Users' personal information is a consistent principle of HamCQ Community. HamCQ Community protects personal information through technical safeguards, strengthened internal management, and other measures. Except where disclosure is required by law or a legally authorized government authority, or where the User has given prior express authorization, HamCQ Community will not publicly disclose or provide to a third party a User's private personal information or non-public Content stored while using the services.
To operate and improve HamCQ Community technologies and services, HamCQ Community may independently collect and use, or provide to third parties, information that is not private personal information. This helps us provide a better user experience and service quality.
By using or continuing to use our services, you agree that we may collect, use, store, and share relevant information in accordance with the HamCQ Community Privacy Protection Guidelines. Please refer to the HamCQ Community Privacy Policy for details.
Chapter IV Disclaimers
Article 1. HamCQ Community cannot guarantee the correctness of answers or comments published by Users.
Article 2. Content published by a User represents only that User's position and views and does not represent the position or views of HamCQ Community. The publisher is responsible for the Content. The publisher shall bear the legal liability arising from disputes caused by the Content. HamCQ Community bears no legal or joint liability except where applicable law provides otherwise.
Article 3. HamCQ Community does not guarantee that network services will meet every User requirement, remain uninterrupted, or always be timely, secure, or accurate.
Article 4. HamCQ Community is not responsible for interruptions or other defects caused by force majeure or circumstances outside its reasonable control, but will endeavor to reduce resulting losses and impact.
Chapter V Amendments
Article 1. HamCQ Community may amend this Agreement in response to developments of the internet, changes to applicable laws, regulations, or regulatory documents, or business needs. When this Agreement changes, HamCQ Community will publish the revised Agreement directly on its website and notify Users of the change. HamCQ Community may also provide additional notice by email or private message regarding amendments, service changes, or other important matters.
Article 2. If a User does not agree to an amendment, the User has the right and obligation to stop using HamCQ Community immediately. Continued use of HamCQ Community after an amendment takes effect constitutes acceptance of the amended provisions to the extent permitted by applicable law.
Chapter VI Special Statements
Article 1. Third-party services:
- HamCQ Community may contain third-party links or services. Users assume the risks of using third-party services.
- HamCQ Community is not responsible for the security or accuracy of third-party services.
Article 2. Technical risk notice:
- Amateur radio operation involves technical risks. Users should possess the necessary knowledge and skills and operate with due care.
- Users are responsible for losses caused by improper technical operation.
Article 3. Additional disclaimers:
- HamCQ Community does not guarantee that services will be entirely uninterrupted or error-free, or that User Content will be accurate or complete.
- HamCQ Community is not responsible for decisions made by Users based on information available through the platform.
Chapter VII Liability for Breach and Dispute Resolution
Article 1. User liability for breach:
- If a User violates this Agreement, the Community Rules, or another service agreement, HamCQ Community and its authorized moderators or administrators may issue a warning, restrict functions, suspend services, or terminate services.
- A User whose breach causes loss to HamCQ Community or a third party shall be liable for compensation.
- Serious breaches may be recorded and may affect the User's subsequent use of services.
Article 2. Dispute resolution:
- The parties should first seek to resolve disputes arising from this Agreement through amicable consultation.
- Any dispute that you encounter within HamCQ Community is unrelated to HamCQ Community unless applicable law provides otherwise.
- You may file a complaint with a competent authority regarding a dispute arising from this Agreement or our processing of your personal information.
- If you believe that our personal information processing infringes your lawful rights and interests, you may report the matter to a relevant government authority.
- You may also bring proceedings concerning this Agreement or our processing of your personal information before a people's court with jurisdiction at the domicile of Haoqi Technology (Xiamen) Co., Ltd.
Article 3. Governing law:
- The formation, performance, and interpretation of this Agreement are governed by the laws of China.
- If a provision conflicts with applicable law or regulation, the applicable law or regulation shall prevail.
Chapter VIII Service Content and Changes
Article 1. Service content:
- HamCQ Community provides a platform for amateur radio technical communication.
- Functions include, without limitation, forum discussions, technical sharing, equipment transactions, and event organization.
- The services and functions actually provided at the relevant time shall prevail.
Article 2. Service changes:
- HamCQ Community may adjust, upgrade, or discontinue certain service functions according to business needs.
- Users will be notified 30 days in advance of a material service change.
- A temporary interruption caused by a technical upgrade will be restored as soon as practicable, and Users will be notified.
Article 3. Service fees:
- HamCQ Community currently provides its basic services free of charge.
- If paid services are introduced in the future, prices will be clearly displayed and User consent will be obtained before purchase.
- Users may choose whether to use a paid service.
Article 4. Service termination:
- A User may terminate the services at any time by closing the account.
- HamCQ Community may stop providing services to a User where permitted by this Agreement.
- Following termination, User data will be processed in accordance with the Privacy Policy and applicable law.
