Hengshui: Guiding minors to use radios legally and in accordance with regulations, demonstrating effective soft enforcement!
Recently, the Hebei Province Bureau of Radio and Telecommunications Supervision in Hengshui, in collaboration with the Hengshui North Station Police Precinct, launched a joint legal awareness campaign themed "Building a Safe Railway Together: Protecting Communication Order," targeting all underage "railway enthusiasts" within the Hengshui area and their guardians. The campaign aimed to educate and guide relevant individuals to voluntarily comply with laws and regulations and conduct amateur radio activities in accordance with the law.
Based on the information provided by the "Railway Enthusiasts" group, which was monitored by the Hebei North Station派出所 using walkie-talkies to monitor railway-specific frequencies, the Hebei Radio Supervision Enforcement Bureau conducted a joint investigation. The group consisted of 9 individuals who used walkie-talkies to monitor railway-specific frequencies and transmit information while on vacation near railway tracks, as well as taking photographs. All of the walkie-talkies were not obtained legally, and the frequencies used did not match the equipment model verification information, which posed a safety risk to train operations and the use of specific frequencies.
Due to the fact that all parties involved in the case were minors, the Hengshui Radio Supervision Enforcement Bureau attached great importance to it and organized internal enforcement personnel to hold a special meeting to discuss the case. Everyone agreed that since the parties involved were minors, this was their first offense and had not caused any serious harm or disruption, they could recognize their mistake and correct it promptly, which complied with Article 30 and Article 33 of the "Administrative Penalty Law of the People's Republic of China." In addition, considering the relevant provisions of the "Regulations on Radio Management of the People's Republic of China" and the case examples of Hebei Province regarding the handling of cases involving unauthorized use of walkie-talkies, a flexible enforcement approach should be adopted for minors involved in the case. No administrative penalties should be imposed, but they should be required to correct their inappropriate behavior, and legal and regulatory education should be strengthened to achieve the desired effect of dissuading illegal behavior. At the same time, this would also serve as a warning to other "train enthusiasts."
To avoid disrupting the learning process for the individuals involved, the Hebei Radio Supervision Enforcement Bureau collaborated with the North Station Branch of the Hebei Public Security Bureau to meet with the individuals and their guardians on weekends. They distributed over 20 copies of materials such as the "Regulations on the Administration of Wireless Telegraphy of the People's Republic of China" and the "Hebei Province Regulations on the Administration of Wireless Telegraphy," providing legal education. In addition, they issued "Notices to Rectify Violations" to five individuals or their guardians who were found to be using walkie-talkies without authorization, in accordance with the law. The five individuals responded positively and signed guarantee letters, committing to conduct amateur radio activities in compliance with the law in the future. This case demonstrates the Hebei Radio Supervision Enforcement Bureau's flexible enforcement approach, its protection of the legal rights of minors, and its guidance towards healthy development for minors.
