Article 44: Except for low-power, short-range wireless transmission equipment, the production or import and sale/use of other wireless transmission equipment within China shall require approval of the type from the national radio management agency. The list of approved types of wireless transmission equipment will be published by the national radio management agency.
The production or import of radio transmitting equipment must obtain approval for the model, in addition to complying with the requirements of Article 43 of this regulation, it must also comply with the technical specifications specified in the certificate of approval for the model of the radio transmitting equipment, and the model approval code must be marked on the equipment.
Article 48: Sales of radio transmitting equipment in accordance with Article 44 of this Regulation must obtain approval for the model, and a sales registration must be filed with the provincial, autonomous region, or municipal radio management agency. It is prohibited to sell radio transmitting equipment that has not been marked with the model approval code as required by this Regulation.
Article 76: Any wireless radio transmission equipment manufactured or imported for sale and use within China that has not obtained type approval in accordance with the provisions of this regulation shall be ordered by the radio management agency to rectify, and a fine of more than RMB 50,000 but no more than RMB 200,000 shall be imposed. If it fails to rectify, the equipment without type approval will be confiscated, and a fine of more than RMB 200,000 but no more than RMB 1,000,000 shall be imposed.
Article 77: If a seller fails to obtain approval for the radio transmission equipment in accordance with Article 44 of this regulation and does not register the sale with the radio management agency, the radio management agency shall order the seller to rectify the situation. If the seller refuses to do so, a fine of between RMB 10,000 and RMB 30,000 will be imposed.
Article 78: Wireless radio transmission equipment that, in accordance with the provisions of Article 44 of this Regulation, has not obtained type approval but is being sold, shall be ordered by the radio management agency to rectify the situation, confiscate the illegally sold wireless radio transmission equipment and illegal profits, and may also impose a fine equivalent to less than 10% of the value of the illegally sold equipment; if it refuses to rectify, a fine equivalent to more than 10% but less than 30% of the value of the illegally sold equipment shall be imposed.
