To all municipal radio management agencies:
To strengthen the management of amateur radio stations, maintain order in the airwaves, and ensure the normal operation of related radio services, in accordance with the "Regulations for the Management of Amateur Radio Stations" and taking into account the actual situation in our province, the following notification is issued regarding relevant matters:
I. Management of Amateur Radio Station Licenses
(1) Application materials. In addition to the application form and proof of identity, photographs of the radio transmitting equipment, applicants who set up and use amateur radio stations must also submit the following materials if they meet specific conditions:
1. Individuals applying to operate or use amateur radio stations without a fixed physical address must provide proof of their legal residence within Zhejiang Province.
2. Individuals under the age of 18 applying to set up or use a non-commercial radio station must submit proof of guardianship and documentation explaining the relationship between the applicant and their guardian.
3. When applying for the establishment and use of a private radio station, the applicant must submit proof of identity for the responsible person, as well as authorization documents from the unit and proof of identity for the technical manager of the private radio station, along with an authorization document from the unit, indicating that the technical manager is an employee of the unit.
4. If applying for a location outside of the province, you must submit necessary documentation including technical specifications, technical solutions, and a self-assessment (including reasons for crossing provincial boundaries, relevant experience, and planned arrangements).
5. In addition to amateur repeater and beacon station call signs, any other amateur radio stations that have obtained amateur radio call signs issued by a regulatory authority outside of this province must submit the proof documents for those call signs.
6. If you intend to use homemade, modified, or assembled radio transmission equipment, you must submit written materials that demonstrate the equipment was indeed homemade, modified, or assembled.
(1)Purchase records for self-made, modified components or assembled parts (if any);
(2)Device list or parts list;
(3)Circuit diagrams to refer to when building your own equipment;
(4)Photos related to the self-made, modified, and assembled process.
(5)Technical specifications table for amateur radio (including operating frequency, occupied bandwidth, transmission power, and other main RF technical parameters).
The applicant must submit all required materials and provide accurate information, and be responsible for the authenticity of the substantive content of their application.
(ii) Operating Frequency. According to Article 15 of the "Regulations for the Management of Amateur Radio Stations," amateur radio stations within Zhejiang Province are permitted to use the frequency bands listed in Appendix 1, after coordination. The frequency planning for amateur repeater stations is shown in Appendix 2.
(iii) Acceptance of application for license. The approving agency shall process applications for the establishment and use of amateur radio stations according to the following circumstances:
1. If the application materials are complete and comply with legal requirements, or if the applicant has submitted all required correction documents, the agency (hereinafter referred to as "this agency") is responsible for processing the administrative permit application.
2. Applicants who intend to establish, operate, or use amateur radio stations for satellite communication or shortwave radio stations with a power output of 15 watts or more, as well as other amateur radio stations that involve national sovereignty and security, must immediately make a decision not to accept the application and inform the applicant to apply to the relevant national radio management agency.
3. Amateur radio stations located outside Zhejiang Province, or applicants whose residence is not within Zhejiang Province, must immediately make a decision to reject the application and inform the applicant to apply to the corresponding radio management agency.
4. If any of the following situations exist, the applicant must be notified in one go within 3 working days regarding all the content that needs to be corrected:
(1)The application materials are missing a signature or official seal, or the signature is unclear and cannot be identified, or the information on the signature does not match the applicant's name.
(2)The application materials are incomplete, do not conform to legal requirements, or contain inconsistent information between different materials submitted for the same application.
(3)The application form for setting up and using a ham radio contains incomplete and inaccurate information.
(4)The physical radio transmission equipment, which was self-made, modified, or assembled by the applicant, does not correspond to the circuit diagram, parts list information, or component list information that it refers to.
For any homemade, modified, or assembled radio transmission equipment, please provide the following information: the time and location for submitting physical materials for inspection, the software required for accessories, and any other relevant details.
(4) Substantive review of materials for approval
1. The review includes the following:
(1)Have the applicant or the technical manager of the amateur radio station successfully completed the required operational skills verification?
(2)Are the radio transmitting devices to be used in compliance with applicable regulations, including whether they have obtained type approval and whether the frequency range specified on the type approval certificate includes amateur business bands?
For self-made, modified, or assembled radio transmitting devices, do they comply with national standards and national radio management regulations, and does the radio transmitting frequency range only cover amateur business bands?
(3)Applicant's previous call sign information.
2. The review process includes:
(1)Whether the written application materials comply with relevant regulations;
(2)Inquire about information regarding verification of operational technical capabilities and approval status of radio transmission equipment models;
(3)Conduct technical inspections on self-made, modified, and assembled radio transmission equipment.
3. Technical inspection of self-made, modified, and assembled radio transmission equipment.
The testing work is based on the national standard "Technical Requirements and Test Methods for Amateur Radio Equipment".(GB/T32658)。
The applicant should bring the equipment to be tested, along with any accessories, software, or other materials required for testing, and undergo testing at the time and location specified by this agency.
The inspection work should be carried out by two personnel with administrative and enforcement qualifications, and the applicant must be present throughout the process. The applicant must cooperate with the inspection work and truthfully answer any questions raised by the inspectors. For each self-made, modified, or assembled radio transmission device application, only one inspection is required. For the same equipment submitted for inspection, the results of the latest inspection should be used. Any objections must be raised on site. After the inspection work is completed, a record of the equipment examination must be prepared on site, and the applicant must sign to confirm the inspection results. The submitted equipment, accessories, software, etc., must be returned to the applicant on site. The entire inspection process should be recorded through audio and video recording.
(V) License decision and radio license (call sign)
1. This agency promises to make a decision on whether or not to grant a license within 15 working days from the date of receiving the application. If a license is granted, a certificate for amateur radio operators will be issued. If a license is not granted, the applicant will be notified in writing and the reasons for denial will be explained.
2. The amateur radio licenses issued by this organization specify the maximum power that the corresponding amateur radio station is permitted to transmit. Amateur repeater and beacon licenses issued by this organization are assigned call signs in the order of installation and are clearly indicated. For other amateur radio licenses, if a call sign has not been previously applied for or has been canceled for more than 1 year, the call sign will be assigned according to the order of installation and clearly indicated; if a call sign has already been obtained and is still valid or was canceled within 1 year, the original call sign will be issued and clearly indicated.
3. Amateur radio stations established in areas outside the province without a fixed location will have their licenses valid for the period specified in the applicant's cross-provincial deployment plan, as stated in the materials submitted to demonstrate the necessity of deploying across provinces. When applying for and using amateur radio stations in other provinces, applicants must comply with the relevant requirements set by the local radio management authorities regarding the use of amateur radio stations.
(6) Changes to License Information. If the license information for a ham radio station is changed, it must be applied for with the radio management agency that made the decision. Except for the call signs of amateur repeaters and amateur beacons, other amateur radio call signs cannot be changed during the validity period of the license.
II. Requirements for setting up, using, and maintaining amateur radio repeaters.
(1) Requirements for setup
1. Amateur repeater stations should establish appropriate management systems and be equipped with effective remote control methods.
2. The first three characters of the amateur repeater call sign for Zhejiang Province are BR5.
3. Each amateur repeater can only use one pair of frequencies, transmitting high and receiving low. Amateur repeaters that transmit and receive on the same frequency can only use one frequency (the higher frequency from the pair). The frequency difference between amateur repeaters that transmit and receive on different frequencies is fixed at:
(1)The transmit-receive frequency difference in the 28 MHz band is 0.1 MHz;
(2)The transmit-receive frequency difference in the 50 MHz band is 1 MHz;
(3)The transmit-receive frequency difference in the 144 MHz band is 0.6 MHz.
It is prohibited to set up and use ground-based amateur repeaters that operate on different frequency bands.
Within the same frequency reuse area, each amateur repeater station independently negotiates and decides on the frequencies to use.
(2) Usage Requirements
1. Amateur repeater stations should make all technical parameters required for using the repeater publicly available.
2. When using amateur repeater communication, you should follow the standard procedures for calling and contacting, and it is prohibited to use nicknames or codes.
3. Amateur radio enthusiasts using amateur repeaters should strengthen self-discipline, communicate in a civilized manner, and comply with the relevant provisions of the "Regulations for the Management of Amateur Radio Stations." They should voluntarily refrain from engaging in activities that fall outside the scope of non-amateur radio use of wireless technology, and jointly create a safe and orderly environment for amateur radio usage. It is prohibited to use amateur radio stations for illegal or criminal activities.
(3) Operational and Maintenance Requirements
1. Amateur repeater stations should establish a monitoring and on-call system. Personnel on duty should record the status of the amateur repeater station and communication logs in the radio log for future reference. When there is no one on duty, the amateur repeater station should be turned off.
2. During duty, if any illegal signals are received or actions that violate amateur radio communication regulations are observed, the on-duty personnel should promptly stop the unauthorized operation and record all relevant details.
3. Amateur repeaters should be able to be remotely turned on and off. If a malfunction, abnormal signal, or interference with other legally established and used radio stations is detected, the repeater should be immediately shut down. If remote control functionality fails or malfunctions, a hard shutdown should be performed at the site of the repeater. After the equipment has been repaired or the situation is normal, the repeater can be restored to operation.
4. Amateur repeaters should establish a recording system that contains time information, and the recording data must be stored for at least 6 months.
5. Amateur repeater stations should conduct maintenance at least once every quarter, checking whether the station's performance indicators meet the parameters specified in its license and relevant regulations regarding radio management, to avoid causing harmful interference to other legally established and used radio stations (stations).
6. The applicant for setting up and using a repeater must be responsible for the safety of the radio station and its associated equipment.
III. Verification of Amateur Radio Station Operating Technical Competence
This agency, or agencies authorized by this agency, will organize and implement the verification of operating skills for amateur radio stations of classes A and B, based on the question bank and standards published by the national regulatory authority for amateur radio.
IV. Supervision and Inspection of Amateur Radio Stations
This department conducts regular inspections of amateur radio stations in operation, strictly adhering to current regulations regarding the management of radio frequencies, laws and regulations, as well as relevant provisions issued by the Ministry of Industry and Information Technology.
The supervision and inspection include reporting on the results of self-checks, immediate checks, special checks, and checks based on complaints and reports. Of these, random checks are conducted once a year, with the objects of inspection selected randomly from 5% of the total number of units or individuals that have obtained amateur radio station licenses and permits. The methods of inspection include on-site verification, written review, monitoring, and testing.
The subject of the inspection should assist in carrying out the inspection, providing truthful answers to relevant questions, and supplying related documents, records, self-assessment reports, previous inspection results, and details on any corrective actions taken (if applicable). The inspection process will be recorded through audio and video.
The inspection includes the following items:
(1) Whether a valid amateur radio license has been obtained;
(ii) Whether they meet the basic requirements for operating a normal amateur radio station.
(3) Whether the amateur radio station (including call sign, location/operating area, frequency band, maximum transmission power, bandwidth usage, approved equipment model code, antenna gain, polarization method, antenna height above ground, equipment serial number, and other specified items as stated in the license) is used in accordance with the items listed on the license and any special regulations.
(4) Whether intentionally transmitting or receiving amateur radio signals outside of the scope specified in the license;
(5) Whether to disseminate, publish, or utilize information received unintentionally.
(6) Whether you independently assign, use, misappropriate, or transfer amateur radio station call signs;
(7) Whether broadcasting or transmitting signals of a public service nature without prior approval;
(8) Whether the use of a ham radio goes beyond the intended purpose for amateur radio operators;
(9) Whether or not amateur radio stations have failed to record or retain logs in accordance with regulations;
(Ten) Do you regularly maintain your amateur radio station?
(11) Whether providing to foreign organizations or individuals information about domestic radio parameters that relate to national security;
(12) Whether concealing relevant information, providing false materials or making false commitments in applying for amateur radio station licenses and permits, or obtaining amateur radio licenses through fraudulent or corrupt means.
(13) Whether to reduce the conditions that applicants must meet or commit to when applying for a radio license;
(14) Other inspection items specified in applicable laws, regulations, and rules.
V. Other Matters
(1) The matters covered in this notice are subject to other regulations issued by the relevant national radio management agency.
(ii) This notice shall take effect from January 1, 2025. "The Zhejiang Provincial Committee of Economy and Information Technology Issues..."<Regulations for the establishment, use, and management of amateur radio repeaters in Zhejiang Province.>(Notification No. ZJGS-ZXG-010 issued by the Zhejiang Provincial Department of Industry and Information Technology) and "The Zhejiang Provincial Commission of Economy and Information Technology on Issuing"<Regulations for Amateur Radio Frequency Use in Zhejiang Province>The notification (Zhejiang Province Department of Industry and Information Technology, No. [2014]11) is also cancelled.
