From a legal perspective, it still constitutes an illegal act.
Article 43: No unit or individual shall use amateur radio stations for the following activities: (iv) Intentionally transmitting or receiving radio signals outside of those specified on the amateur radio license.
Article 48: Any of the following actions shall be handled by the radio management agency in accordance with Article 72 of the "Radio Management Regulations of the People's Republic of China":
(1) Transmitting, publishing, or using radio signals outside of the scope specified in a privately-held amateur radio license, including those obtained unintentionally;

Article 72: Any person who violates the provisions of this regulation and engages in any of the following acts shall be ordered by the radio management agency to rectify the violation, confiscate the illegally obtained income, and may also be subject to a fine of less than RMB 30,000; if the violation causes serious consequences, the license of the radio station will be revoked, and a fine of more than RMB 30,000 but not exceeding RMB 100,000 will be imposed.
(1) Operating a radio station (facility) in violation of the requirements and stipulations specified in the radio station license.
(ii) Intentionally transmitting, broadcasting, or using radio signals outside of the scope of a valid radio station license, including the dissemination or utilization of unintentionally received information.
However, in practice, if you purchase a frequency license, and you don't complain about it, then no one will bother to enforce the regulations.
