Chapter 2: Map Creation
Article 7: Entities engaged in mapmaking activities must obtain the necessary surveying qualifications and licenses in accordance with the law, and conduct mapmaking work within the scope permitted by their qualification level.
Article 8: When creating a map, it should comply with national standards for map production and adhere to national regulations regarding the representation of content on maps.
The map must not depict the following content:
(1) Those that threaten national unity, sovereignty, and territorial integrity;
(2) Those that endanger national security, damage the nation's honor and interests;
(3) Belonging to state secrets;
(4) Those that undermine national unity or violate ethnic customs and traditions;
(5) Content that is prohibited from being expressed according to laws and regulations.
Article 9: When creating a map, the latest available map data should be used and updated regularly. The map must accurately reflect the geographical location, shape, name, and relationships of all elements, and the content must be appropriate for its intended use.
Maps of the world and national maps that depict the territory of the People's Republic of China must accurately represent its boundaries.
Article 10: When drawing the boundaries of the People's Republic of China, historical borders of China, and boundaries between countries and historical borders between countries on maps, the following rules must be followed:
(1) The borders of the People's Republic of China were drawn according to the standard sample chart for delineating Chinese national boundaries.
(2) The historical boundaries of China will be drawn according to actual historical boundaries, based on relevant historical records.
(3) Boundaries between countries were drawn based on standard cartographic representations of international borders.
(4) The historical boundaries between countries will be drawn according to actual historical boundaries, based on relevant historical data.
Standard examples for drawing China's borders, and reference examples for drawing the borders of other countries, were drafted by the Ministry of Foreign Affairs and the State Council's Survey and Mapping Geographic Information Administration, and were published after approval by the State Council.
Article 10: When drawing administrative boundaries or areas of provinces and above in China on maps, the drawings must comply with the standard map drawing methods for administrative boundaries, special administrative regions approved by the State Council, and other relevant regulations issued by the state.
The standard drawing method for administrative district boundaries was formulated by the Ministry of Civil Affairs and the State Administration of Surveying, Charting and Spatial Information, after being approved by the State Council. It was then published for general use.
Article 12: When indicating important geographical information data on a map, it should use data that has been officially published and approved.
Article 13: When creating maps based on survey results that involve state secrets, the relevant parties must use survey results that have undergone confidentiality processing by the surveying and mapping administrative departments of the State Council or the local governments of provinces, autonomous regions, or municipalities directly under the central government, in accordance with applicable laws and regulations.
Article 14: Government departments at the county level and above responsible for surveying and mapping geographical information should make public maps for non-commercial use.
Administrative departments at the county level and above responsible for surveying and geographic information should promptly organize the collection of relevant administrative division, place names, transportation, waterway, vegetation, public facilities, and residential area changes related to map content. This information is used for regular updates of public maps. Relevant departments and organizations must provide this updated information in a timely manner.
Chapter 3: Map Review
Article 15: The state implements a system of map review.
Maps that are made publicly available should be reviewed and approved by the relevant surveying and mapping administrative agency. However, this requirement does not apply to simple maps such as tourist maps, neighborhood maps, and subway route maps.
Map review services are not permitted to charge fees.
Article 16: Maps published by publishing units must be submitted for review; maps displayed or reproduced in publications that do not meet the definition of a "publication" must be submitted by the exhibitor or publisher; importers of maps or products with map graphics that do not meet the definition of a "publication" must submit them for review; importers of maps that meet the definition of a "publication" must comply with the relevant provisions of the "Regulations on the Administration of Publications"; exporters of maps or products with map graphics that do not meet the definition of a "publication" must submit them for review; manufacturers of products with map graphics must submit them for review.
The following documents should be submitted for review:
(1) Map review application form;
(2) Maps or samples that require review;
(3) A surveying qualification certificate issued to the mapping unit.
For products that are not maps or accompanying map graphics of publications, only the materials specified in paragraph (1) and (2) of this section need to be submitted. When creating maps using survey results involving state secrets, a confidentiality processing certificate must also be submitted.
Article 17: The administrative department of the State Council responsible for surveying and geographic information is responsible for reviewing the following maps:
(1) Maps of the entire country and maps showing major areas encompassing administrative regions of two or more provinces, autonomous regions, or municipalities directly under the central government.
(2) Maps of Hong Kong Special Administrative Region, Macau Special Administrative Region, and Taiwan region;
(3) The world map includes maps of foreign countries, with particular emphasis on major regions.
(4) Historical maps.
Article 18: The administrative departments responsible for surveying and mapping geographical information of the provincial, autonomous, or directly-administered municipal governments are responsible for reviewing maps that primarily depict features within their respective administrative areas. Specifically, maps depicting features within the administrative area of a municipality do not involve national borders and are reviewed by the administrative department responsible for surveying and mapping geographical information at the municipal level.
Article 19: The administrative department responsible for reviewing map applications shall make a decision on the application within 20 working days from the date of receiving the application.
For maps included in news and current affairs publications, or those requiring high timeliness, the decision on their review application must be made within 7 working days from the date of receipt of the application.
For emergency situations or other special circumstances where maps are required, they should be reviewed immediately upon receipt.
Article 20: Maps containing professional content must be reviewed according to the review criteria established by the administrative department of the State Council responsible for surveying and geographic information, in collaboration with relevant departments. If there are no specific review criteria, the administrative department responsible for surveying and geographic information with the authority to review will solicit opinions from relevant departments. These departments must submit their opinions within 20 working days after receiving the request for opinion materials. The time spent soliciting opinions does not count towards the deadline for reviewing the map.
Maps of the world, historical maps, and maps used for current affairs propaganda that do not have clear approval criteria must be reviewed by the administrative department of the State Council responsible for surveying and geographic information, in consultation with the Ministry of Foreign Affairs.
Article 21: Maps that comply with the following requirements will be approved by the surveying and mapping administrative agency authorized to review them, and a map approval document will be issued, indicating the approval number.
(1) Complies with national standards for mapmaking, accurately representing the territory of the People's Republic of China.
(2) The map must include national boundaries, territorial borders, historical demarcations, administrative district boundaries or areas, important geographical data, place names, and other information that complies with the relevant regulations regarding cartographic content established by the state.
(3) Contents that are not permitted to be shown on the map.
The approval documents and survey map reference numbers must be promptly announced on the website of the surveying and mapping administrative agency with authority, or other news media.
Article 22: Maps that have been approved after review must be clearly marked with the approval number in a conspicuous location on the map or on the product containing the map. For maps included in publications, the approval number must be indicated on the copyright page.
Article 23: National and regional primary and secondary school teaching maps shall be reviewed and approved by the Ministry of Education, in collaboration with the State Survey and Mapping Administration and the Ministry of Foreign Affairs. Local primary and secondary school teaching maps shall be reviewed and approved by the education administrative departments of provincial, autonomous region, and municipal governments, in collaboration with the corresponding survey and mapping administration departments.
Article 24: No unit or individual shall publish, display, print, sell, import, or export maps that do not comply with national standards and regulations. Furthermore, no unit or individual shall bring into or out of the country maps that do not comply with national standards and regulations.
For import and export maps, you must submit a map review approval document and the corresponding review number to customs.
Article 25: Maps that have been approved after review must be submitted to the relevant surveying and mapping administrative authorities by the applicant, free of charge, in accordance with applicable regulations.
